Terms and Conditions.
The applicant of the HUE+MAN Design Competition agrees with the following terms and conditions.
1 Application Requirements
Art 1.1
The applicant fulfills the following requirements
I consider myself as part of the BIPoC (Black, Indigenous, People of Color) community
I am 18 years old or older
I have basic knowledge of English
I apply alone or I am in a team of two. Bigger teams are not allowed
My talent has not been discovered by the broad public yet. I am not yet able to make a decent living out of my skills
Art. 1.2
The work submitted has to belong mainly to at least one of the following disciplines
Graphic Design
Fashion Design
Architecture and Interior Design
Industrial Design
Environmental Design
Art. 1.3
The participation is free of charge. Deadline for the participation is April 30th 2021.
Art. 1.4
USM U. SCHÄRER SÖHNE AG (hereinafter also: USM) reserves the right to exclude applicants from participation, provided that an exclusion is objectively justified. An objective reason exists in particular if an applicant does not fulfill the aforementioned requirements.
2 Declaration of independence
Art. 2.1
The applicant confirms, that the submitted works and reflections are his/her own.
3 Process of competition
Art. 3.1
The applicant is familiar with the competition process, which is as follows:
Round 1. Anyone who meets the application requirements can apply through the online platform by filling out the required fields. Applicants can apply with existing work, also work that has been published and commercialized already. After the applications deadline, the team members of the HUE+MAN Design competition will select the finalists.
All applicants will be informed by e-mail if they were selected as a finalist or not.Round 2. Finalists are invited to submit their applications for round 2 by filling out the required fields on the online platform. Only selected finalists can apply for round 2. In round 2 the submitted work has to address the theme and the guiding questions defined by the project team.
After the applications deadline, the Jury of the HUE+MAN Design competition will select the finalists.
All applicants will be informed by e-mail if they are among the winners or not.
4 Evaluation Criteria

The applicant agrees with the evaluation criteria of round 1 which are as follows:

5 Evaluation process and feedback
Art. 5.1
Every project team member (round 1) and every jury member (round 2) will attribute a score from 1-10 for each evaluation criteria to every application. Decisions will be taken on the basis of that score and discussions that the project team and the jury will conduct.
Art. 5.2
After round 1 the applicants will not receive a feedback on their score. They are either invited for round 2 or not without further explanation.
After round 2 all finalists will receive a feedback of their evaluation.
Art. 5.3
The effort and resources (time and money) that the applicant invests are not remunerated by USM U. SCHÄRER SÖHNE AG.
Art. 5.4
A fair evaluation process is important to us. However, the evaluation of quality is a subjective process. The assessment in the evaluation process corresponds to the subjective opinion of the team and jury members and will possibly differ from your consideration. The results of the competition and persons involved cannot be legally challenged.
6 Marketing conditions
Art. 6.1
Names, submitted works and reflexions (text, pictures, videos, protoptypes, etc.) of the winners will be published by USM U. SCHÄRER SÖHNE AG on websites and other channels and used for marketing purposes.
Art 6.2
Neither USM nor any other person or company has the right to use the winners or other applicants intellectual property for commercial interests. The copyright remains at all times with the respective applicant.
7 Award/Trophy money
Art. 7.1
3 applicants will win the competition with rank 1 to 3. The competitions award consists of trophy money. The money needs to be spent as an investment in the talent’s career and work.

The winners have to account for the use of the trophy money. They create a budget of their intended spending before the money is transferred to an account. Subsequently, the spending must be proven with receipts. USM U. SCHÄRER SÖHNE AG reserves the right to pay out the trophy money in installments.
Art. 7.2
The actual amount transferred is equal to the current currency rate and minus fees and taxes, if any. Both, the applicant and USM are each individually respsonsible for declaring and paying their taxes.
8 Legal recourse and liability
Art. 8
No correspondence will be entered about the competition, unless expressly provided otherwise herein. The legal recourse is excluded. There is no enforceable claim to the payment of the trophy money.
Data communication via the Internet cannot always be guaranteed to be error-free and available according to the current state of technology. USM U. SCHÄRER SÖHNE AG is therefore not liable for the constant and uninterrupted availability of the online systems used, nor for technical and electronic errors of a tele media service over which USM U. SCHÄRER SÖHNE AG has no control, in particular not for disruptions such as the loss, delay, alteration, manipulation or misdirection of e-mails, which have their cause in external data networks, external telephone lines or other hardware or software of the participants or third parties. The same applies to malfunctions with regard to the entry, recording, transmission and storage of data, in particular also for faulty, missing, interrupted, deleted or defective data records.
Furthermore, no liability is assumed if e-mails or data entries (in masks of the competition pages) do not comply with the requirements set out therein and are consequently not accepted by the system. USM U. SCHÄRER SÖHNE AG is also not liable in the event of theft or destruction of the systems or storage media storing the data. The same applies in case of unauthorized modification or manipulation of the data by the participants or third parties.
USM U. SCHÄRER SÖHNE AG shall only be liable for damages other than those resulting from injury to life, body or health insofar as these are based on intentional or grossly negligent actions on the part of USM U. SCHÄRER SÖHNE AG or its vicarious agents. In the event of a culpable breach of an essential contractual obligation, USM U. SCHÄRER SÖHNE AG shall also be liable for negligent breaches of duty. Essential contractual obligations are those that make the execution of the contract possible in the first place and on whose compliance the participant may regularly rely. In this case, however, liability is limited to foreseeable damages typical for the contract. Any liability beyond this is excluded.
9 Final provisions
Art. 9.1
In case one of the provisions in those terms and conditions should be or become invalid, this shall not affect the validity of the remaining provisions.
Art. 9.2
The courts at the registered office of USM U. SCHÄRER SÖHNE AG in Münsingen, Switzerland have sole jurisdiction over any disputes arising from or in connection with the HUE+MAN Competition. The HUE+MAN Competition and any disputes arising out of or in connection with it shall be governed exclusively by Swiss law, excluding the conflict of laws rules. Mandatory provisions and jurisdictions of Swiss law and any applicable foreign law remain reserved.
